A divorce simply means that you and your spouse are no longer legally married. It’s important to understand that divorce doesn’t finalise the property or parenting matters between you.

Divorce can often be one of the last steps for a separated couple, after the parenting and property matters have finally been resolved.

What are the requirements for a Divorce?

  • You are legally married;
  • The relationship has irretrievably broken down (and there is no reasonable prospects that you will get back together);
  • You and your spouse have been separated for at least 12 months (which can include living separated under one roof); and
  • At least one of the parties is an Australian citizen or resident, or otherwise lives permanently in Australia.

If there are children under the age of 18, you will also need to satisfy the Court that “adequate provision” has been made for the children’s care.

There are some types of Divorce Applications that don’t require you to attend Court.
